Terms and conditions

This translation is provided for convenience. Only the German version is legally binding.
1. Scope and provider
These terms apply to the use of Rcado (catalogue, classifieds market and retailer directory for RC gear) by private individuals (“users”) and commercial providers (“retailers”). The provider is Julien Lieske, c/o Autorenglück #62015, Albert-Einstein-Str. 47, 02977 Hoyerswerda, Deutschland (“we”). Section 12 additionally applies to retailers only. Deviating terms do not apply.
2. Our service - we only act as an intermediary
3. Account
- You need an account to post listings, send messages, use search alerts and manage your own listings. You must be of legal age and have full legal capacity.
- You log in via a link sent to your email address, without a password. Protect access to your mailbox; you are responsible for actions taken through your account.
- One account per person is enough. Your details must be correct; the email address must belong to you and be reachable.
- Your display name is visible to others, as is your seller profile with your member-since date, the number of your listings (had online, currently online, reported as sold) and your response rate to enquiries. You choose the name yourself; names that infringe the rights of others, deceive, insult, contain contact details or sound like the operator are not allowed.
- You can delete your account at any time in your profile. Listings, photos and conversations are then permanently removed.
4. Posting listings
Accurate and complete: Title, description, condition, price, photos and location must be correct. Photos show the item offered; third-party images (manufacturer photos, stock images) are not allowed as listing photos. Only your own goods: You may only offer what belongs to you or what you are authorised to sell. Commercial providers use the retailer area, not private listings. Info screen: For transmitters, receivers and turbines, a photo of the device’s info screen (serial number, firmware, operating hours if applicable) is mandatory. The serial number is only stored as a hash and checked against the theft register. Prohibited items: Weapons and weapon-like objects, class 3 lasers and above, animals, illegal content and radio equipment that can’t be approved in Germany, Austria or Switzerland must not be offered. For batteries (e.g. LiPo), you observe the dangerous goods regulations for shipping. Contact through the platform: Contact details and links that bypass the platform don’t belong in the title and description; we hide them automatically. You reach interested buyers through messages. Duration: A listing runs for 60 days. Shortly before it ends we remind you by email; there you can renew it, mark it as sold or withdraw it. When you sell, you can voluntarily enter the final price. Editing: You can change the title, description, condition, price, location, shipping method and photos. Not the category, catalogue product or serial number; for those, withdraw the listing and post it again.
5. Rights to your content
Texts and photos remain yours. You grant us the simple, non-exclusive right to store them for the duration of the listing, display them in resized versions, make them available in search and to search engines, and reproduce them for operating the service. This right ends when the listing or account is deleted, unless legal obligations or anonymised statistics prevent this. You confirm that you hold the rights to your photos and texts and don’t infringe the rights of third parties.
6. Pre-check, moderation and blocking
We automatically check listings against fixed rules (prohibited items, serial number in the theft register, unusual prices, contact details in listing texts). We reject prohibited items immediately; suspicious listings are reviewed by a human and may stay online meanwhile. We can block or delete listings, messages and accounts if they violate these terms or the law, if there is a justified suspicion of fraud or stolen goods, or if third parties show through reports that content is illegal. We decide based on severity, repetition and the circumstances.
7. Reporting content
Every listing and every message has “Report”, even without an account. Give a reason and explanation and confirm that your information is correct to the best of your knowledge (Art. 16 DSA). We confirm receipt, review the report and inform you and the affected person of the decision with a statement of reasons. Anyone who misuses reports to harm others can be blocked.
8. Messages and conduct
Messages are for contact about listings. Insults, harassment, spam, fraud attempts and moving communication or payment to insecure channels are prohibited. You can block any user in the conversation and lift the block again; the history is kept, new messages are blocked in both directions, and the blocked person isn’t told the reason. We can view messages if they have been reported or there is a justified suspicion of a violation.
Contact and payment details in messages: You may mention contact details in messages. If our system checks a message and finds email addresses, phone numbers, messenger IDs or references to a payment (e.g. PayPal, bank transfer, IBAN), we show both sides a notice in the conversation. It is only for information. We don’t assess what you agree and are not liable for arrangements and payments outside the platform (section 10). New accounts: During the first 2 days after registration you can’t send contact details or links in messages; we hide them automatically. This protects against automated scam messages.
9. Theft register
Checking is free and possible without an account. The result is “no entry” or “reported stolen”. A report is a claim by the person reporting it, not a finding by us. “No entry” is no guarantee that a device isn’t stolen. Only report what is true and keep the entry up to date. Anyone who knowingly reports falsely is liable for the resulting damage and will be blocked. Anyone who feels wrongly reported (e.g. a buyer whose listing was blocked) can object to the entry at kontakt@rcado.de with proof (receipt, serial number). We review the case and disclose the decision to the reporter and the affected person. The operator spot-checks entries.
10. Purchases between users
Purchase contracts are concluded exclusively between users. They agree on price, payment, shipping, handover and warranty among themselves; mandatory law remains unaffected. We recommend inspecting the goods before paying, paying in person on pickup, making sure of protection when shipping and not pushing for payments outside the platform. We are not liable for defects, delivery and payment between users.
11. Price information and catalogue
12. Retailers
12.1 Registration and activation
Retailers register with company name, address, VAT ID, shop address and delivery countries. We activate shops after review and can refuse activation. Offers only appear for activated shops.
12.2 Prices and plans
Use is free during the launch phase. We will announce a switch to paid plans at least 30 days in advance in text form; we communicate plans, prices, term and cancellation before booking. We charge neither commission on sales nor fees per click.
12.3 Obligations
- Prices are final prices including VAT; shipping costs are shown separately and correctly (PAngV).
- Availability, delivery time and product data in the feed must be correct. We hide offers that a feed hasn’t confirmed for 72 hours; if the feed fails several times, we hide all offers and inform you.
- The retailer is the seller. They provide the legal notice, cancellation policy, product safety information (GPSR) and all consumer information in their own shop; we don’t handle the purchase process.
- Retailers may not post private listings, use the platform for sales outside their offers or infringe third-party rights to texts or images.
- Retailer products that the catalogue doesn’t know are only created provisionally by the retailer; we can change, merge or reject them.
12.4 Restriction and termination
We can restrict, suspend or terminate offers, shops or access if the retailer violates these terms or the law or feeds contain false information. We communicate this with a statement of reasons on a durable medium. We give at least 30 days’ notice of termination unless an important reason or a legal obligation requires immediate action. Retailers can terminate at any time; the notice period of a paid plan also applies. We then delete the shop’s data unless there is an obligation to retain it.
12.5 Changes to these terms
We notify retailers of changes affecting them at least 15 days in advance in text form. Retailers can terminate during this time; continued use after the period expires counts as acceptance.
13. Ranking and placement (transparency)
13.1 Listing results and search
The list of used listings only contains listings from private users. You choose the sorting yourself (newest, price ascending or descending, by distance if a location is given); the default is “newest first”. There is no paid position in this list; retailers can’t buy one either.
13.2 Product pages
On the product page, used listings come before offers of new goods. Retailer offers are sorted by total price (item plus shipping to Germany) in ascending order by default. No single retailer is highlighted (“buy box”); payments or plans don’t influence this order. Availability and delivery time are shown on an equal footing next to the price.
13.3 Retailer ads between results (advertising)
They only appear for a search with a search term, category, product or manufacturer, and only if the offer matches the search (search words, category, price range and attributes, new goods allowed, delivery to the search location). No earlier than after used listing no. 4, then at most once every 8 positions, at most 3 per page and one offer per retailer and page. With equal relevance, retailers rotate daily. If there are fewer than 4 used results, up to 4 matching retailer offers appear below the results in a separate “New from retailers” block. Who may appear as an ad: during the free phase, all activated shops, free of charge. The free phase ends when traffic and sales on the platform reach a threshold set by us; we will announce this at least 30 days in advance. After that, only retailers with a paid Pro plan appear. We count impressions and clicks per offer and day without any personal reference; they are used for billing and evaluation.
14. Availability and changes to the service
We strive for trouble-free operation but don’t owe uninterrupted availability. Maintenance, faults or force majeure can restrict access. We can change, replace or discontinue features if this is reasonable for users; paid services remain unaffected for the period paid for.
15. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breaches of essential contractual obligations (obligations whose fulfilment the user regularly relies on), our liability is limited to the foreseeable damage typically occurring. Otherwise we are not liable for slight negligence. This also applies to acts of our employees and vicarious agents. We are not responsible for content from users and retailers, their goods, their information and the conduct of users towards each other; we review notices of illegal content in accordance with section 7.
16. Changes to the terms for users
If we change these terms significantly, we inform you by email or at your next login. The changes apply once you accept them at your next login; if you don’t accept, you can delete your account. Section 12.5 applies to retailers.
